1. Scope

Welcome to Velion! These terms of use govern the legal relationship between you (hereinafter "User") and the operator (hereinafter "Provider") when using the website velion-daw.de and the Velion DAW software.

Velion is a Digital Audio Workstation (DAW) developed for music production. By using the website and/or the software, you agree to these terms.

If you do not agree to these terms, you may not use our services.

2. Free Provision

The use of Velion DAW is completely free of charge. No license fees, subscription costs, or hidden charges apply. The provision is voluntary and without any legal entitlement to specific availability or functionality.

3. Permitted Use

Velion may be used for the following purposes:

• Music production – Creating your own music and audio projects
• Sound design – Creating sound effects and audio elements
• Audio editing – Editing and optimizing audio files
• Private projects – Non-commercial music projects
• Commercial projects – Commercial music productions
• Learning and education – Use for educational purposes

4. Prohibited Use

The following activities are prohibited:

• Illegal use of the software
• Reverse engineering, decompiling or disassembling of the software, except as permitted by law (e.g., for achieving interoperability)
• Using copyrighted material without appropriate authorization
• Using the software for military or war purposes
• Distributing modified versions without explicit permission
• Removing copyright notices or license information
• Automated mass generation of music without human control

5. Intellectual Property

Velion DAW and all associated components, with the exception of parts explicitly marked as Open Source, are the intellectual property of the Provider. All rights reserved.

The user is granted a limited, non-exclusive, non-transferable license to use the software in its unmodified form.

The license does not include the right to copy, lend, rent, resell, or publicly distribute the software, unless permitted by law.

6. Rights to Created Projects

All content you create with Velion (music, projects, audio files) belongs to you. The Provider makes no claim to your creative works. You retain all copyright and usage rights to your projects.

7. Availability and Updates

The software is provided without warranty regarding specific availability. Updates, bug fixes, or new versions are released at the sole discretion of the Provider. There is no legal entitlement to updates, support, or a specific version.

8. Limitation of Liability

The Provider shall be fully liable for intent and gross negligence as well as for damages resulting from injury to life, body, or health. Otherwise, the liability of the Provider is excluded to the extent that no mandatory legal provisions conflict.

Use of the software is at the user's own risk. The Provider is not liable in particular for data loss, hardware damage, lost profits, or consequential damages arising from the use of the software, unless caused by intent or gross negligence.

9. Privacy

10. Changes to Terms

The Provider reserves the right to change these terms of use at any time with effect for the future. Changes will be published on this page.

For significant changes, users will be informed by email or through a notice on the website. Continued use after the changes take effect constitutes acceptance.

11. Termination of Service

The Provider reserves the right to discontinue, modify, or replace the provision of Velion DAW and the associated website at any time without stating reasons. There is no legal entitlement to the continued existence of the service.

12. Final Provisions

The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is, to the extent legally permissible, the seat of the Provider.

Should any provision of these terms of use be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. An effective provision that comes closest to the economic purpose of the invalid provision shall apply in its place.
